Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

Hunt Culture Clothing:
The sole proprietorship Hunt Culture Clothing, established at Dieze 19, 5751 XE Deurne, the Netherlands, registered with the Dutch Chamber of Commerce, hereinafter referred to as "Hunt Culture", "we", "us" or "our".

Consumer:
Any natural person acting for purposes outside their trade, business, craft or profession who enters into an agreement with Hunt Culture.

Agreement:
Any agreement concluded between Hunt Culture and the consumer through the webshop.

Product:
Any item offered for sale by Hunt Culture through the webshop.

Webshop:
The official Hunt Culture Clothing website through which products are offered and sold.

In Writing:
Written communication also includes communication by email or other electronic means, provided that the information can be stored for future reference. 


Article 2 – Business Identity

  5.  Hunt Culture Clothing can be contacted by email. We aim to respond to all enquiries within 1–2 business days.

 

Article 3 – Applicability

  1. These Terms & Conditions apply to every offer made by Hunt Culture Clothing and to every agreement concluded through our webshop.
  2. By placing an order, the consumer confirms that they have read and accepted these Terms & Conditions.
  3. Any deviations from these Terms & Conditions shall only be valid if confirmed in writing by Hunt Culture Clothing in advance.
  4. If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that reflects its original purpose as closely as possible.
  5. In situations not covered by these Terms & Conditions, Hunt Culture Clothing will act in accordance with applicable Dutch law and the principles of reasonableness and fairness.

 

 

Article 4 – The Offer

  1. We make every reasonable effort to ensure that all product information, prices, images and descriptions on our webshop are accurate and up to date.
  2. Product images are provided for illustrative purposes. Although we strive to display colours and details as accurately as possible, slight variations may occur due to differences in screen settings or mobile devices.
  3. Obvious errors, mistakes or typographical errors relating to prices, product information or other content on the webshop are not binding on Hunt Culture Clothing. We reserve the right to correct such errors, even after an agreement has been concluded.
  4. If a product unexpectedly becomes unavailable after an agreement has been concluded, we will inform the consumer as soon as possible. In such cases, the order may be cancelled or adjusted by mutual agreement. Any payments made for unavailable products will be refunded using the original payment method.

 

 

Article 5 – Prices and Payment

  1. All prices displayed on the webshop are stated in euros (€) and include VAT, unless explicitly stated otherwise.
  2. Any applicable shipping costs will be clearly displayed before the consumer completes the order.
  3. Hunt Culture Clothing reserves the right to change prices at any time. Price changes will not affect orders that have already been confirmed.
  4. Payment must be made using one of the payment methods offered during the checkout process.
  5. An order will be processed once payment has been successfully received or, where applicable, authorised by the selected payment provider.
  6. If a payment is declined, cancelled or otherwise unsuccessful, Hunt Culture Clothing reserves the right not to process or to cancel the order.

 


Article 6 – Delivery

  1. Hunt Culture Clothing processes and dispatches orders as soon as possible after payment has been received.
  2. Delivery times stated on the webshop are estimates. Although we make every reasonable effort to deliver orders within the indicated timeframe, no rights can be derived from these delivery estimates.
  3. If an order is delayed due to unforeseen circumstances, we will inform the consumer as soon as reasonably possible.
  4. The risk of loss or damage to a product passes to the consumer once the product has been received by the consumer or by a third party designated by the consumer, unless otherwise provided by law.
  5. If an order cannot be delivered because incorrect or incomplete address details were provided, the consumer is responsible for any resulting consequences. Additional shipping costs resulting from such errors may be charged.
  6. If a product becomes temporarily or permanently unavailable after an order has been placed, we will notify the consumer as soon as possible. In such cases, the order may be cancelled or adjusted by mutual agreement. Any payments made for unavailable products will be refunded using the original payment method.

 


Article 7 – Right of Withdrawal

  1. The consumer has the right to withdraw from a distance agreement within 30 days of receiving the product, without giving any reason.
  2. During the withdrawal period, the consumer must handle the product and its packaging with due care. The product may only be inspected in the same way that would be permitted in a physical retail store.
  3. If the consumer exercises the right of withdrawal, the product must, where reasonably possible, be returned complete, undamaged and in its original condition, in accordance with the return instructions provided by Hunt Culture Clothing.
  4. The consumer must notify Hunt Culture Clothing of their intention to exercise the right of withdrawal within the withdrawal period. Once notification has been given, the product must be returned within 14 days.
  5. The right of withdrawal does not apply to products that are excluded from this right under applicable law. Where such an exception applies, this will be clearly stated on the relevant product page.



Article 8 – Returns and Refunds

  1. If the consumer exercises the right of withdrawal, the direct costs of returning the product are the responsibility of the consumer, unless otherwise agreed or unless the product was delivered incorrectly, damaged or defective.
  2. After receiving and inspecting the returned product(s), Hunt Culture Clothing will refund the amount due as soon as possible and no later than 14 days, in accordance with applicable legislation.
  3. If the entire order is returned within the withdrawal period, the standard shipping costs paid for the original order will also be refunded. If only part of the order is returned, the original shipping costs will not be refunded.
  4. Refunds will be issued using the same payment method used for the original transaction, unless the consumer expressly agrees to a different payment method.
  5. Hunt Culture Clothing may withhold the refund until the returned product(s) have been received or until the consumer has provided proof that the product(s) have been returned, whichever occurs first.

Article 9 – Warranty and Conformity

  1. Hunt Culture Clothing guarantees that the products supplied conform to the agreement, meet the reasonable expectations the consumer may have, and comply with all applicable legal requirements at the time of delivery.
  2. The consumer's statutory rights and legal warranty remain fully applicable. Nothing in these Terms & Conditions limits or excludes those rights.
  3. If a product is received damaged, defective or incorrect, the consumer is requested to contact Hunt Culture Clothing as soon as possible via info@huntcultureclothing.com, so that we can work together to find an appropriate solution.
  4. The warranty does not apply to damage resulting from normal wear and tear, improper use, inadequate maintenance, alterations made to the product, or any other cause not attributable to Hunt Culture Clothing.
  5. If a complaint regarding a product is found to be justified, Hunt Culture Clothing will, depending on the circumstances and in accordance with applicable law, repair or replace the product, provide an appropriate price reduction, or issue a refund.

 


Article 10 – Liability

  1. Hunt Culture Clothing shall only be liable for damage where such liability arises under applicable law or where the damage results from intentional misconduct, gross negligence, or any other circumstance in which liability cannot legally be excluded.
  2. Hunt Culture Clothing shall not be liable for damage resulting from improper use of a product, normal wear and tear, inadequate maintenance, or failure to follow any care or washing instructions provided with the product.
  3. To the extent permitted by law, Hunt Culture Clothing shall not be liable for indirect or consequential damages, including but not limited to loss of profit, loss of savings, or any other form of indirect financial loss.
  4. Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is not permitted under applicable law.

 


Article 11 – Complaints

  1. If you have a question or are dissatisfied with a product or our service, please contact us at info@huntcultureclothing.com. We will do our best to find a suitable solution together. Please describe your question or complaint as clearly as possible and include your order number where applicable.
  2. We aim to handle every complaint with care and to provide a substantive response within 14 days. If more time is required, we will inform you accordingly.
  3. If we are unable to resolve the complaint together, the dispute may be submitted to the competent court or to an appropriate dispute resolution procedure where applicable under the law.

 


Article 12 – Force Majeure

  1. Hunt Culture Clothing shall not be obliged to fulfil its obligations where performance is reasonably impossible due to circumstances beyond its reasonable control (force majeure).
  2. Force majeure includes, but is not limited to, natural disasters, war, pandemics, government measures, strikes, disruptions affecting carriers, internet or payment service outages, and any other circumstances beyond the reasonable control of Hunt Culture Clothing.
  3. During a force majeure situation, Hunt Culture Clothing's obligations shall be suspended. If performance becomes permanently impossible, both parties shall have the right to terminate the agreement in whole or in part without liability for damages, to the extent permitted by applicable law.

 


Article 13 – Governing Law and Final Provisions

  1. These Terms & Conditions and all agreements between Hunt Culture Clothing and the consumer shall be governed exclusively by Dutch law, unless mandatory legal provisions require otherwise.
  2. Any disputes shall be submitted to the competent Dutch court, unless another court has mandatory jurisdiction under applicable law.
  3. If any provision of these Terms & Conditions is found to be wholly or partially invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects its original purpose and intent.
  4. Hunt Culture Clothing reserves the right to amend these Terms & Conditions. The version applicable to an agreement shall always be the version in force at the time the agreement was concluded.

Article 14 – Intellectual Property

All images, designs, logos, texts and other content displayed on this webshop are the property of Hunt Culture Clothing or are used with permission. They may not be copied, reproduced, distributed or otherwise used without the prior written consent of Hunt Culture Clothing, unless permitted by applicable law.
